What is a Homeowner's Association (HOA)?

A non-profit organization registered with the state and managed by a duly elected Board of Directors. The purpose is to maintain all common areas and to govern the community in accordance with the provision oflegal documents (Code of Conduct & Ethics, Bylaws and Articles of Incorporation).

HOAs also collect monthly or annual dues to pay for upkeep of those common areas like the swimming pool and can levy special assessments on homeowners when the association lacks sufficient reserves to pay for unexpected repairs. The corporation is financially supported by all members of the homeowners association. Membership is both automatic and mandatory.

What is the Board of Directors?

The Board of Directors is the governing Board of Directors that is required to oversee the homeowner’s association’s business. The Board of Directors is elected by the homeowners, or as otherwise specified in the bylaws. The limitation and restrictions of the powers of the Board of Directors is outlined in the Association governing documents.

Is there an annual assessment or monthly association fees?

Yes. Monthly fees are required for all SWVCA residents and they are due on the first day of the month. Payments for Association fees can be mailed to the address listed below or paid via PayPal.

What are the association fees used for?

These funds are used for several things associated with maintenance of common areas, enforcing Association rules, and general operations of the Association.

Do I need a PayPal account to pay association fees online?

No. You can use a number of payment options with PayPal including major debit and credit cards without a PayPal account.  To submit a payment, go to https://paypal.me/swvca.

What happens if I do not pay my fees or assessment?

The Georgia Condominium Act states that unpaid assessments constitute a lien against your property. Under said Act, the Board of Directors has the authority to pursue legal action and you can be denied access to all of the common elements, including parking spaces, of the Association. A lien may be placed on any property that is more than 2 months or $500 in arrears.

I would like to make changes to my patio or garage. Is this ok?

Any exterior alteration, modification, or change to the common elements or limited common elements (i.e., patio, garages, etc.) must have written approval of the Board of Directors PRIOR to the implementation of desired changes. All requests must be submitted in writing to the Board. Please refer to your Rules and Regulation guide for more information on what to include. 

If I am having a problem with a neighbor for a violation of the Policies/Restrictions, what can I do?

All complaints of violations of these Rules & Regulations must be in writing. Violations will be investigated by the Board or by a person(s) designated by the Board. Appropriate action will be taken by the Board in the event of any violations of these Regulations. Should the violation warrant the assessment of fines, the Bylaws will be followed to the letter. Reports of violations that are beyond the scope of these Rules & Regulations will be referred to the appropriate authorities.

What do I do if need maintenance?

Complete a Maintenance Request form to add your request to the queue.

What do I do if misplaced my mailbox key?

If you lost or misplaced your mailbox key, please visit the Austell Post Office. The fee to
replace your key is $45, and it normally takes 1 to 2 business days to have your lock changed.

How can I get involved?

There are several meetings throughout the year that are open to all. They are held in the SWVCA Clubhouse. Annual meetings are held in December.  

We encourage you to attend our community meetings. Please check the website for meeting dates.
